一、 課程說明
憲法，一方面是國家的根本大法，另方面也是人民權利的保障書。當代憲政主義從18世紀
萌芽，到了21世紀的今天，發展已臻成熟。全世界目前超過三分之二以上的國家，擁有合
乎當代憲政主義的民主憲法與實際運作。台灣也不例外。這門課希望透過對憲法基本原
理、憲法條文、憲法實踐以及憲法解釋的探討，讓同學對於當代憲政主義以及我國憲法的
規範與實踐，都有清楚的理解以及進一步分析批判的能力。
在課程設計上，這門課是以憲法基本原理與條文為骨幹，憲法實踐—尤其是司法院大法官
的憲法解釋為血肉，來進行關於憲法的討論。這門課所指定的教科書，尤其注重對於憲法
案例的討論與分析，希望在增進同學對於憲法規範瞭解的同時，也能對於憲法實際運作有
清楚認識。因此，修課同學對於指定教材的事先閱讀，以及上課時對於相關案例的發言討
論，是這門課最基本的上課態度與條件。學期初，會先將同學進行分組，授課教師會以組
為單位，隨堂要求同學發言。這門課將有期中考與期末考，考試皆為open book，並於考前
一週將可能選考考題事先公布。考試不在測驗同學的背誦能力，而是希望看出同學理解的
深度以及獨立思考的批判能力。

本課程將非常重視學生的課堂討論與參與。修課同學必須在每次上課前閱讀指定資料，並
參與課程討論。學期成績將以上課參與（25%）、期中考(35%)、以及期末考（40%）綜合評

1. Course Description
Constitution is the fundamental law of the land and the guarantee of basic
rights. Contemporary constitutionalism, burgeoning in the eighteenth century,
has reached its peak. Today, more than two third of nations in the globe have
constitutions consistent with basic principles of modern constitutionalism,
and
Taiwan is no exception.

This course is designed to give a comprehensive understanding of
constitutional
law in Taiwan. In addition to theoretical inquiries, the discussion of
constitutional interpretations and other constitutional practices will also be
included. This course is mainly in lecture style, but class discussion is not
to be ignored. Students are expected to prepare readings before the class and
participate fully in class questions. Active class participation is one of the
requirements in taking this course. Mid-term and final will be open book.
Class
participation (25%), mid-term brief (35%) and final exam (40%) would be
included accordingly into final evaluation and grades.
